                   AN ORDINANCE TO AMEND ORDINANCE NO. 9698
                   ENCAPTIONED AS SET FORTH HEREIN, SO AS TO AMEND
                   THE CONDITIONS  ON A TRACT OF LAND LOCATED
                   AT 1604 GUNBARREL ROAD, BEING ON THE SOUTHEAST
                   LINE OF GUNBARREL ROAD NORTHEAST OF EAST
                   BRAINERD ROAD, MORE PARTICULARLY DESCRIBED
                   HEREIN AND AS SHOWN ON PLAT ATTACHED HERETO AND
                   MADE A PART HEREOF BY REFERENCE.

              WHEREAS, on April 21, 1992, the City Council of the City 
of
         Chattanooga, Tennessee, enacted Ordinance No. 9698 encaptioned, 

         "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS 

         THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED 
IN
         THE 1500 BLOCK OF GUNBARREL ROAD, BEING ON THE SOUTHEAST LINE 
OF
         GUNBARREL ROAD NORTHEAST OF EAST BRAINERD ROAD FROM R-1
         RESIDENTIAL ZONE TO R-4 SPECIAL ZONE, SUBJECT TO CERTAIN
         CONDITIONS."; and
              WHEREAS, the owner of said tract now desires to amend the
         conditions therein so as to reduce the right-of-way requirement 
to
         80'; to approve two driveways, and to approve alternate 
landscape
         plans; and
              WHEREAS, the Planning Commission held a public hearing on 
the
         petition on February 8, 1993; and
              WHEREAS, the Planning Commission heard and considered all
         statements favoring or opposing the petition;
                                  NOW, THEREFORE,
              BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance 9427, encaptioned as set 

         forth above, be and the same is hereby amended by amending the
         conditions for the reduction of the right-of-way requirement to 

         80'; approve two driveways, subject to approval of City Traffic 

         Engineer; and approve alternate landscape plan subject to 
review
         and approval of Landscape Ordinance staff.
              BE IT FURTHER ORDAINED, that this ordinance shall take 
effect
         two weeks from and after its passage, the public welfare 
requiring
         it.
